Reporting Requirements for Agencies
The Maryland Statistical Analysis Center (MSAC), which resides within the Governor’s Office of Crime Prevention and Policy’s Research, Analysis, and Evaluation Division, partners with law enforcement agencies, State’s Attorney’s offices, public safety agencies, public health entities, advocates, and legislators to develop guidance for collecting and submitting information to ensure compliance with the law. For information regarding mandated reports, including the data submission requirements for each, please refer to the list below.
*Data must be submitted by the below due dates to allow MSAC time to organize, analyze, and report the information as required. All submissions must follow the provided guidance and templates to ensure compliance; otherwise, agencies may be asked to resubmit the data using the specified format. If your agency does not have data to submit, your agency must inform MSAC by the due date. Agencies that do not submit the required data or notify MSAC that they do not have data to report may appear in notifications to lawmakers, identifying non-compliant agencies. Non-compliance may also impact grant funding opportunities.
Moving forward, data for most legislative mandates will be submitted to MSAC through Qualtrics surveys. SWAT Team and No-Knock Search Warrants
Section 3-508(b) of the Public Safety Article requires law enforcement agencies to report information on SWAT team activities. Section 3-525(b) requires law enforcement agencies to report information on search warrants – specifically no-knock search warrants. To reduce the number of data submission, agencies should use the Qualtrics survey to submit State fiscal year data (July 1 – June 30) by July 15 only.

NOTE: Law enforcement agencies use one reporting template to account for both requirements. The due date for § 3–508(b) was changed from January 1 and July 1 of each year, to July 15 of each year; and the due date for § 3–525(b) was changed from January 15 to July 15. Because § 3–525(b) specifies no-knock search warrants, all other search warrant data (e.g., GPS, DNA, electronics, etc.) is not required.
Seizure and Forfeiture
Section 12-602(a) of the Criminal Procedure Article requires each seizing authority in consultation with the corresponding forfeiting authority to report information on the seizure and forfeiture of property related to violations of Controlled Dangerous Substances law. Data must be submitted to the center by March 1 of each year.

Deaths Involving a Law Enforcement Officer
Section 3-507(b) of the Public Safety Article requires law enforcement agencies to report information on each officer-involved death and death in the line of duty that involved a law enforcement officer employed by the agency. Data must be submitted to the center by March 1 of each year.
NOTE: Agencies should only complete the survey if they have deaths to report.
Death in Custody Reporting Act (DCRA)
The Death in Custody Reporting Act (DCRA; Public Law No. 113-242) requires states to report to the Bureau of Justice Assistance (BJA) any deaths that occur while an individual is detained, under arrest, in the process of being arrested, en route to be incarcerated, or is incarcerated at any correctional/detention facility. All law enforcement, detention facilities, or any other entity with the authority to arrest/detain citizens in Maryland must report information to the Governor’s Office of Crime Prevention and Policy regarding any deaths in custody. Data must be submitted by January 15, April 15, July 15, and October 15 of each year.
Forensic Genetic Genealogical DNA Analysis and Search
Section 17-105 of the Criminal Procedure Article requires a report on requests for forensic genetic genealogical analysis for the preceding year. State’s attorney’s offices and law enforcement agencies should submit information to the center by March 1 of each year.

NOTE: Information should only be submitted on cases that resulted in a signed affidavit in order to test the DNA digital file.
Traffic Stop Data
Section 25-113 of the Transportation Article requires law enforcement agencies to submit information as it relates to traffic stops. The Maryland State Police provides a data dump of all ETIX and Delta+ data which is merged together. Data must be submitted by March 1 of each year.

Use of Force Incidents
Section 3-528(b) of the Public Safety Article requires law enforcement agencies to report each use of force incident that resulted in a monetary settlement or judgment. Data must be submitted in Qualtrics by March 1 of each year.
NOTE: Section 3–514(b)(3) of the Public Safety Article states that if a law enforcement agency has not submitted use of force information to the Maryland Police Training Commission by July 1 for the previous calendar year, the Governor’s Office of Crime Prevention and Policy may not make any grant funds available to that law enforcement agency.
Pretrial Detention
Section 9-3208(b) of the State Government Article requires each county and the Division of Pretrial Detention and Services to report information to the Justice Reinvestment Oversight Board, which is housed in the Governor’s Office of Crime Prevention and Policy, by March 31 of each year.
DNA Evidence Collection
Section 2-514(a) of the Public Safety Article requires law enforcement agencies to report information on the status of crime scene DNA collection and analysis in their respective jurisdiction for the preceding year. Data must be submitted in Qualtrics by April 1 of every even-numbered year.
Facial Recognition Technology
Section 2-510 of the Criminal Procedure Article requires law enforcement agencies using or contracting the use of facial recognition technology to prepare and publish an annual report that discloses specified information. Reports must be submitted to the office by May 1 of each year.
Opioid Use Disorder Examinations and Treatment
Section 9-603(j) of the Correctional Services Article, through House Bill 116 (2019) - PDF, requires local correctional facilities to report information on the examination and treatment outcomes of incarcerated individuals with an opioid use disorder. Data must be submitted to the center by August 1 of each year.

Interrogation Rooms
Section 2-404 of the Criminal Procedure Article requires a report on the progress in establishing interrogation rooms capable of creating audiovisual records of custodial interrogations. Law enforcement agencies must submit the required information in Qualtrics by October 1 of every year.
Restrictive Housing
Section 9-614(b) of the Correctional Services Article requires all correctional units to report information on restrictive housing. Data must be submitted to the center by December 31 of each year.
In Custody Witness
Section 10-924 of the Courts and Judicial Proceedings Article requires State’s Attorneys to report any obtained testimony from an in-custody witness to the Governor’s Office of Crime Prevention and Policy as it relates to the substance of the in-custody witness’s testimony, even if the testimony is not presented in a court proceeding; the purpose for which the State’s Attorney used the testimony; and whether the in-custody witness received a benefit and, if so, what the benefit is or will be. Data must be submitted whenever testimony of an in-custody witness is used. Please follow the data sharing protocol below to ensure secure transmission of this information.
